Attorney Walter Kelley, managing attorney of the law firm's Massachusetts offices, said, "Kelley Bernheim Dolinsky, LLC has taken a vanguard role in the Stryker Rejuvenate and ABG II hip litigation. In addition to the recent Massachusetts Stryker lawsuit, we are aggressively litigating product liability claims against Stryker in Florida and New Jersey."
These lawsuits are not class action lawsuits but rather individual personal injury claims against the devices' manufacturer, Howmedica Corp. d/b/a Stryker Orthopaedics. In these product liability lawsuits, Plaintiffs do not allege any negligence by the implanting surgeons. Rather, plaintiffs allege that Stryker failed to adequately test the ABG II and Rejuvenate hips to insure that they would not corrode, erode, deteriorate and induce severe metal toxicity in patients.
Attorney Kelley added, "Stryker seized the opportunity to increase profits in the wake of the DePuy ASR metal-on-metal hip recall by fast tracking the Rejuvenate and ABG II through the FDA without any clinical testing. Then, they marketed the device to surgeons and patients as a safe alternative to the metal-on-metal devices so widely publicized for failing due to heavy metal toxicity."
He added, "Sadly, the neck/stem junction on the Rejuvenate and ABG II hips is still metal-on-metal, and friction between these parts can lead to corrosion and fretting, causing small particles of potentially toxic Cobalt and Chromium ions to be released into a patient's bloodstream. These metal particles (metallosis or metal poisoning) can cause severe and permanent tissue and bone death and may have long term systemic side effects to a patient's entire body.
"Stryker must be held accountable to patients and their families for their inexcusable decision to put profit ahead of patient safety. We are aggressively working to make sure it happens in a fair and timely manner," he said.
